They're both red sorceries, they both cost 2R, they're both uncommon:

The only difference between the cards is that Mark of Mutiny gives the creature a +1/+1 counter. But does this make the card better? At the end of the turn, the controlled creature returns to it's owner, but with that +1/+1 counter! Is this a downside or not?

I ran into this issue while looking for a sideboard card when playing against some aggro matchup with my goblin deck.

What do you think?

I think that these cards would mostly be used in aggro decks, where the +1/+1 counter would do more good than bad. The purpose is usually to steal a creature and attack with it, so you don't care so much about making the target creature bigger after you're done with it.

So I vote for Treason (though I personally don't play Aggro much and dislike giving +1/+1 counters to opposing creatures).

As with anything else, it depends on the circumstance.

If you are playing a deck and you notice that games are often won/lost by one life, take Mark of Mutiny. If you can kill the creature before it gets returned to your opponent (for example, if you have sacrifice a creature costs), Mark of Mutiny is obviously better. If you just want the creature to use an ability it has, or as a surprise attack, Act of Treason is better.

I don't think anyone can help you more than that unless you post your decklist.

i think that mark is crazy good in the aggro saturated limited zendikae format. It is even better than a regular threaten spell. It could still back fire but usually I think i could just tip the game enough for a win if you had a decent aggresive start.

I'd go with Act of Treason. There are circumstances where you need additional 1 damage to finish off the opponent but that would likely less to happen. So the +1/+1 counter would be disadvantageous to you.
